SALES CONDITIONS 

These general sale conditions govern the purchase of products made online through the shop.caffemauro.com website. The products purchased on shop.caffemauro.com are directly sold by Kynetos S.r.l., hereinafter referred to as the "Seller".
Kynetos S.r.l. is a company registered in the Register of Companies Forlì with Tax Code and VAT Reg. no. 03544820404 and legal office in FC - Forlì (FC) - ZIP Code 47121, Capital Equity: Euro 100.000,00 fully paid-up.

1. Our marketing policy
1.1
The Seller offers the sale on shop.caffemauro.com of the products and exclusively carries out its electronic business activity toward its end “Consumers”.

1.2
"Consumer" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on shop.caffemauro.com.

The Seller reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Seller's business policy.

These General Terms and Conditions of Sale (together with the documents referred to herein) regulate the offer, transmission and acceptance of purchase orders relating to products on shop.caffemauro.com between the users of shop.caffemauro.com and the Seller.

2. How to finalize a contract with the Seller
2.1
To finalize a purchase contract for one or more products on shop.caffemauro.com, you will have to fill in the order form in electronic format and send it to the Seller online, following the relative instructions.

The order form includes a summary of the information on the essential characteristics of each ordered product and its relative price (inclusive of all applicable taxes and levies), of the payment methods you may use to purchase each product, and of the delivery terms of the purchased products, of the shipment and delivery costs, of the conditions of how to exercise the right to withdrawal, and of the modes and times for returning purchased goods.

The contract is finalized when the Seller receives the order form via web, upon prior assessment of the accuracy of the data relative to the order.

2.4
Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Conditions of Sale.

2.5
The order form will be archived in our database for the time necessary to process the orders and, at any rate, as required by law. You will be able to view your order form by accessing the reserved area with your codes.

2.6
The Seller may not process the purchase orders that do not provide sufficient guarantee that they will be paid, or that prove incomplete or incorrect, or rather, if the products are unavailable. In such cases, we will make sure to inform you via email that the contract has not been finalized and that the Seller has decided not to process the purchase order, specifying the reasons for its decision. Were the products displayed on shop.caffemauro.com not to be any longer available or for sale at the time of your last access to the website, or rather, at the time in which the order form was sent, it will be responsibility of the Seller to inform you, within thirty (30) days, starting from the day after the one in which you will have sent your order to the Seller, that the products ordered are not available. In case the order form has been sent and the purchase price paid, the Seller will proceed to reimburse you the amount you have already advanced.

By sending the order form online, you unconditionally accept and undertake commitment to comply with, in your relations with the Seller, the General Sale Conditions disclosed by it. If you do not agree with certain terms reported in the General Sale Conditions, we invite you not to send the order form for the purchase of products on shop.caffemauro.com.

By sending the order form, you confirm that you are aware of and accept the General Sale Conditions and the added information listed on shop.caffemauro.com, even those recalled through links, including the General Conditions of Use and the Privacy Policy.

2.9.
Once the contract is finalized, the Seller will send a receipt of the purchase order via email, which will include a summary of the information already contained in the order form.

3. Warranties and indication of the product prices
3.1
The essential characteristics of the products are presented on shop.caffemauro.com within each product sheet. The images and colors of the products offered for sale on shop.caffemauro.com may, however, not correspond to the real ones, due to the visual effect of the internet browser and the monitor used.

3.2
The Seller does not sell used or invalid products, or ones with a level of quality lower than the correspondent standards offered on the market.

3.3
The Seller, in case the right to withdrawal is exercised, is entitled not to accept returned products that have been altered in their essential and quality characteristics, or that have been damaged.

3.4
Prices are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price of sale before sending the relevant order form.

3.5
Orders made from a Country site different from the one you are shipping to, or to addresses to which the Seller cannot ship, will be automatically cancelled.

4. Payments
4.1
The prices listed are inclusive of VAT, confections, and packaging.

4.2
To make payment of the price of the products and of the relative shipment expenses, you may follow one of the modes indicated in the order form.

4.3
In case payment is made with a credit card, the financial information (e.g. credit/debit card number or its date of expiry) will be forwarded via cryptographed protocol to Banca Sella or other banks, which provides the relative services for long distance electronic payments, without third parties being able in any way to access them.
Such details will not be used by the Seller except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the corresponding costs for shipping and delivery, as indicated in the order form, will be charged to your current account only when the purchased products are actually shipped.

4.4
The purchase price of the products and the shipment expenses, as pointed out in the order form, will be charged to your bank account at the time the purchased products are shipped.

7. Right to withdrawal
7.1
If you are a “consumer” (in other words, a person who acts for purposes that are foreign to an entrepreneurial, marketing, artisan, or professional activity possibly carried out) you have the right to withdraw from the contract finalized with the Seller, without incurring any fine and without having to specify the reason, within fourteen (14) working days, starting from the date in which you receive the products purchased on shop.caffemauro.com, providing notification thereof to the Seller.

7.2
To withdraw from the contract, you will have to specify the products purchased, the number of the relative order, your personal identification data, and your bank coordinates (bank account holder name and number, ABI, CAB, CIN - bank coordinate codes) to obtain reimbursement of the amount paid for the products purchased. You will have to return the products to the Seller, who must receive them within fourteen (14) working days, starting from the date in which you received the products.

7.3
The shipment expenses for the delivery in origin of the products purchased will not be reimbursed. The shipment of returned goods, instead, is free of charge, were you to decide to use our carrier. In the case, instead, that you decide to use a different carrier, the shipment expenses for the goods returned will be your responsibility.

7.4
The right to withdrawal is, at any rate, subjected to the following conditions (in addition to those specified in the previous points):
The waybill must be correctly filled out;
The right to withdrawal is only applied to goods that are intact at the time they are returned;
The products must not have been used, modified, or damaged;
The products must be returned in a single shipment to the Seller;
The products must be returned in their original package;
The Seller must receive the returned products within fourteen (14) working days, starting from the date in which the order is delivered.
7.5
If the withdrawal is exercised in compliance with the conditions reported above, the Seller will proceed to reimburse to the customer the entire amount collected for the purchase of the products, within 14 days from the date in which the Seller has become knowledgeable that you have exercised your right to withdrawal.

7.6
If the modes and terms that govern the right to exercise withdrawal are not complied with, you will not be entitled to receive reimbursement of the amounts already paid to the Seller; however, you will be entitled to receive, at your expense, the products back, in the condition they were returned to the Seller. If otherwise, the Seller will be entitled to withhold the products, in addition to the amounts already paid for their purchase.

8. Times and modes of reimbursement

After the products are returned, the Seller proceeds to make the necessary ascertainments concerning their compliance with the conditions and terms pointed out in paragraph 7. If the ascertainments have a positive outcome, the Seller will send the relative confirmation that the returned products have been accepted via email.

You are advised to read, if you haven't already done so, our General Terms and Conditions of Use which also contain important information on how we process the personal data of our users and on the security systems of shop.caffemauro.com.

10. Applicable law and settlement of legal disputes
10.1
The General Sale Conditions are governed by Italian law and, more specifically, by Law Decree no. 206, dated September 6, 2005, and subsequent amendments and integrations thereto, concerning the code of ethics that rules consumption, with specific reference made to the norm(s) that concern long distance contracts, and by Law Decree no. 70, dated April 9, 2003, that rules on certain aspects that concern electronic trade.

11. Amendments and updates
11.1
The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on shop.caffemauro.com.
